1. Introduction

Welcome to FlexBuddy. These Terms of Service ("Terms") govern your use of the FlexBuddy mobile application (the "App") and related services (collectively, the "Services"), operated by Quantra Tech LLC ("we", "us", or "our").

FlexBuddy is an independent third-party route optimization tool designed exclusively for Amazon Flex drivers aged 18 and older. We are not affiliated with, endorsed by, or connected to Amazon or Amazon Flex.

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Services.

2. Eligibility and Age Requirements

18+ Only: FlexBuddy is intended solely for Amazon Flex drivers who are 18 years of age or older. By using our Services, you represent and warrant that you are at least 18 years old and are an active Amazon Flex driver.

Amazon Flex Account Required: You must have an active Amazon Flex driver account to use our Services. FlexBuddy enhances your existing Amazon Flex experience but does not replace or modify Amazon's services.

3. Service Description

FlexBuddy provides route optimization and tracking tools for Amazon Flex drivers, including:

• Route optimization based on your chosen end destination
• Real-time progress tracking and delivery analytics
• Route history and performance metrics
• Earnings and fuel savings tracking
• Route comparison between Amazon's routing and optimized alternatives

Important: FlexBuddy provides suggestions and analytics only. You remain solely responsible for following all Amazon Flex policies, traffic laws, and safe driving practices.

4. Amazon Flex Compliance and Independence

No Amazon Flex Policy Violations: FlexBuddy is designed to comply with Amazon Flex's terms of service and privacy policies. Our app:

• Never accesses your Amazon Flex account or credentials
• Never collects or stores customer personal information, names, or contact details
• Never collects or stores package tracking numbers or shipment details
• Never stores recipient addresses beyond what's necessary for route optimization
• Never communicates with Amazon's servers or systems
• Never interferes with or modifies the Amazon Flex app

Data Minimization: We only collect delivery addresses temporarily for route optimization and your performance metrics. We do not collect, store, or process any customer personal data, package contents information, or sensitive delivery details that could violate Amazon Flex's privacy policies.

Independent Operation: FlexBuddy operates completely independently from Amazon Flex. We do not modify Amazon's systems, access their APIs, or interfere with their operations in any way.

5. Accessibility Service Usage

FlexBuddy uses Android Accessibility Service exclusively to read route information visible on your Amazon Flex app screen. This service:

• Only reads delivery addresses and route data already visible to you
• Only operates when you actively request route import
• Never accesses passwords, personal data, or other applications
• Never stores or transmits sensitive information
• Provides the same functionality as manually entering route data

Proper Use: You agree to use the accessibility service only for its intended purpose of importing your Amazon Flex route data. Any misuse of accessibility permissions may result in immediate account termination.

6. Subscription Service

Premium Features: FlexBuddy offers premium route optimization features through a paid subscription service.

Free Trial: New users may receive a 7-day free trial of premium features. You may be required to provide payment information to activate the free trial, but you will not be charged until the trial period ends.

Recurring Billing: Premium subscriptions automatically renew at the end of each billing period unless cancelled. You will be charged the then-current subscription fee.

Cancellation: You may cancel your subscription at any time through the App settings or by contacting support. Cancellation takes effect at the end of your current billing period.

7. Service Limitations and Disclaimers

No Guarantees: FlexBuddy provides route optimization suggestions based on available data. We do not guarantee:

• Specific fuel savings or earnings increases
• Route completion times or distances
• Availability of the Amazon Flex app or services
• Accuracy of traffic data or route calculations

Driver Responsibility: You remain solely responsible for:

• Safe and legal driving practices
• Following all Amazon Flex policies and procedures
• Complying with local traffic laws and regulations
• Verifying route information and delivery requirements
• Maintaining your Amazon Flex account in good standing

Service Dependencies: FlexBuddy depends on the Amazon Flex app and third-party services (maps, traffic data). Service interruptions may occur due to factors beyond our control.

8. Prohibited Uses

You agree not to use FlexBuddy:

• In violation of any applicable laws or regulations
• In violation of Amazon Flex terms of service or policies
• To access, collect, or store customer personal information
• To interfere with Amazon Flex operations or systems
• For any purpose other than optimizing your own Amazon Flex routes
• To share your account access with other drivers
• To reverse engineer or attempt to extract our algorithms
• In any way that could harm FlexBuddy, Amazon Flex, or other users

9. Account Security and Sharing

Account Responsibility: You are responsible for maintaining the security of your FlexBuddy account and all activities under your account.

No Sharing: FlexBuddy accounts are for individual use only. Account sharing is prohibited and may result in immediate termination.

Suspicious Activity: We reserve the right to investigate and take appropriate action regarding suspicious account activity.

10. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the practices described in our Privacy Policy.

11. Refunds

Refund requests for subscription fees may be considered on a case-by-case basis at our sole discretion. Factors we consider include:

• Length of service usage
• Technical issues affecting service quality
• Compliance with these Terms of Service

12. Intellectual Property

The Services and their original content, features, and functionality are owned by Quantra Tech LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

13. Termination

By You: You may terminate your account at any time through the App settings.

By Us: We may terminate or suspend your account immediately, without prior notice, for any violation of these Terms, including but not limited to:

• Misuse of accessibility permissions
• Violation of Amazon Flex policies
• Prohibited account sharing
• Fraudulent or harmful activity

Effect of Termination: Upon termination, your right to use the Services will cease immediately, and any data associated with your account may be deleted.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEXBUDDY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Services
• Any changes to Amazon Flex policies or services
• Route optimization suggestions or calculations
• Service interruptions or technical issues
• Any conduct or content of third parties
• Unauthorized access to your account or data

15. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Services will meet your specific requirements
• Route optimization will result in specific savings
• The Services will be uninterrupted or error-free
• All errors or defects will be corrected

16. Amazon Flex Relationship Disclaimer

No Affiliation: FlexBuddy is an independent third-party application and is not affiliated with, endorsed by, sponsored by, or connected to Amazon, Amazon Flex, or any of their subsidiaries or affiliates.

No Responsibility for Amazon Actions: We are not responsible for any actions taken by Amazon Flex regarding your driver account, including but not limited to account suspension, deactivation, or policy changes.

Compliance Responsibility: While FlexBuddy is designed to comply with Amazon Flex policies, you remain solely responsible for ensuring your use of our Services complies with all applicable Amazon Flex terms and conditions.

17. Updates and Modifications

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the App or via email. Continued use of the Services after such modifications constitutes acceptance of the updated Terms.

18. Governing Law and Disputes

These Terms shall be governed by the laws of New Jersey, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
